The role of the electronic judge in managing cases in the trial

Abstract

The research aims to achieve a clear primary objective, which is to outline the role of electronic litigation in managing and improving cases in commercial courts, due to its effective role in addressing the various challenges faced by these courts. From this main objective, several sub-goals emerged, which enhance the ability of commercial courts to achieve swift justice. Among the most important of these is identifying the legislative challenges that hinder the implementation of electronic litigation or obstruct its application in Egyptian commercial courts, as well as highlighting the key future opportunities that can be utilized to take advantage of electronic litigation in Egyptian commercial courts in the future.

The research led to several findings, most notably that electronic litigation represents a qualitative shift in the methods and mechanisms of dispute resolution. It offers characteristics that contribute to expediting procedures and reducing costs, which helps improve access to swift justice in commercial cases. Furthermore, the current legislation in Egypt needs development and increased flexibility in a way that aligns with technological advancements, safeguarding the country from the drawbacks of adopting new models such as electronic litigation in the future. This model presents significant challenges that require a visionary and effective approach to formulating laws that are compatible with it, thus achieving the main objective of swift justice.
