The legislative and institutional framework for transitional justice and national reconciliation in Libya

Abstract

The issue of transitional justice and national reconciliation in Libya is one of the topics worthy of study and research by focusing on the legislative and institutional framework, especially in light of the existence of legislation recently issued in Libya in an attempt by the Libyan legislator to approve the legal mechanisms necessary to achieve national reconciliation in this country, and to get out of the current situation. Which resulted from the repercussions of the events of 2011 AD, and led to wars and internal conflicts fueled by external parties, which resulted in a political division, weakness in state institutions, and a deterioration in the level of services provided to citizens, and based on that, this study focuses on researching the concept and content of transitional justice and national reconciliation from A legal perspective, and its legislative and practical reality, as an important means to address the current situation in Libya, to get out of the current crisis, and to cross towards building the state, as it is the key to stability in building the state of institutions and the rule of law, and an important pillar and necessary condition for achieving development in all fields.

The study also focuses on analyzing the texts and provisions of Law No. 29 of 2013 AD on transitional justice, examining the mechanisms and means adopted by the Libyan legislator through the approval of this law, examining the extent of his ability to contribute to achieving transitional justice and the desired national reconciliation, and comparing it with some transitional justice laws. In some countries, as well as identifying the reasons and legal obstacles that prevented the success of the experience of transitional justice and national reconciliation in Libya.
