Upon global Warming and its abnormal catastrophic risks of climate change, Upon Warsaw International Mechanism on Loss and Damage (WIM) which provides nothing in terms of action and support to protect people from harm, Upon sustainable development goals in Egypt 2023 and with respect to climate change, Now and for the protection of future generations’ rights, it is the time of global necessary especially after Coronavirus Pandemic, for national legal scholars to start facing those catastrophic risks form the legal aspect.
For Egypt and till now, Egypt does not face any climate change litigation or any litigation regarding climate change duty of care but with respect to its greenhouse gas emissions which will be increased in the future, now is the accurate time for Egyptian scholars to start focusing on foreign legal solutions to avoid or prevent any potentional future harm especially French Vigilance law enacted in 2017 as an example for civil law system and proposal for Eu directives on due diligence.
This study will be a comparative study and will be divided into three elements:
1- Trends in climate change litigation, 2- Climate Change Duty of Care in Civil Law System, 3- Climate Change Duty of Care in Common Law System.
