COVID-19 has multiple impacts on some rights more than others. This pandemic has affected well-established rights, which are difficult if not impossible to avoid internationally, legislatively, judicially, or doctrinally.
In the midst of this tensed atmosphere, the phenomenon of expulsion of foreigners from pandemic-affected countries rose. It seems to be one of the most important effects of COVID-19 on rights in view of its consequences on the future of humans, the stands of countries, the provisions of international conventions, and international organizations.
The study will attempt to discuss the expulsion of foreigners from pandemic-affected countries both theoretically and practically, which necessitates addressing three aspects: Firstly, tracking the legal characterization of how countries have dealt with foreigners. Secondly, examining the position of comparative legislation on the issue in France, Egypt, and the UAE. Thirdly, examining the various approaches of countries towards the expulsion of foreigners in the wake of the pandemic and illustrating the validity of the decisions of expulsion issued during the pandemic.
The study then tackles a precise question: is Covid-19 considered an exceptional circumstance that allows States to deport foreigners from its territory? This requires scrutiny of three issues: Firstly, the essence of an exceptional circumstance from a health perspective, in particular the health reasons that authorize countries the right to deport foreigners. Secondly, the relation between Covid-19 and public order, the legal rationale for the deportation of foreigners whose presence pose a threat to public order, and the position of international conventions on the permissibility of restricting human rights to protect public order. Thirdly, the reasons for the criticism directed at public order as a justification for the deportation of foreigners.
